Proponen reformas a la Constitución en
materia de identidad de género
• La iniciativa fue presentada por la diputada Pérez Valdez, del PRD
• Se busca erradicar y eliminar toda forma de discriminación
La diputada Elizabeth Pérez Valdez (PRD) presentó una iniciativa que propone reformar el artículo 4º de la Constitución Política para establecer que indistintamente de la identidad de género que de forma libre elijan, la mujer y el hombre son iguales ante la ley.
En la propuesta señala que el objetivo es erradicar y eliminar toda forma de discriminación, porque todas las personas deben gozar de los mismos derechos, y el Estado tiene la obligación de garantizar la equidad y la igualdad sustantiva eliminando sesgos y brechas de desigualdad.
La iniciativa, turnada a la Comisión de Puntos Constitucionales, para dictamen, y a la de Diversidad, para opinión, resalta que es indispensable eliminar los prejuicios sociales y culturales que subyacen en efectos negativos tales como los crímenes de odio, erradicando la concepción de que los derechos humanos se encuentran limitados o diferenciados debido a la identidad de género.
Muestra que las desigualdades producidas por la absurda idea de la preeminencia de un género o “grupo dominante” ha tenido como consecuencia el menoscabo en los grupos considerados como vulnerables, implantando la idea de una heteronormatividad patriarcal, como punto de partido para el ejercicio de los derechos, imponiendo que todo aquello que no se ajuste es incorrecto.
Indica que el Estado como ente regulador debe proveer las condiciones para que todas las personas encuentren el pleno desarrollo y ejercicio de su persona e identidad, sin que ello le imponga algún estereotipo o discriminación.
En la iniciativa se manifiesta que se deben realizar los ajustes correspondientes en la Constitución para garantizar que todas y todos los hombres y mujeres, en la libre autodeterminación que nuestra máxima Constitución les otorga, gocen de la identidad de género como derecho humano; por ello, se deben eliminar actos de discriminación y sesgos de género, y reafirmar que todas y todos somos iguales ante la ley.
