Para crear un registro sobre los datos estadísticos e informativos de las niñas, niños y adolescentes que han quedado en condición de orfandad, la diputada Raquel Bonilla Herrera (Morena) planteó reformas a la Ley General de los Derechos de Niñas, Niños y Adolescentes.
El documento, enviado a la Comisión de Derechos de la Niñez y Adolescencia, prevé que el Sistema Nacional de Protección Integral, elabore un Registro Nacional de Orfandad para brindar certeza y seguridad jurídica a las acciones integrales de protección y restitución de los derechos de las niñas, niños y adolescentes que por cualquier situación se encuentren en orfandad.
Asimismo, para que accedan a los programas sociales que implanten las autoridades federal, estatal, municipal o de las demarcaciones territoriales de la Ciudad de México, para su atención.
Para ello, el Sistema Nacional de Protección Integral celebrará instrumentos y mecanismos de coordinación con los registros civiles de las entidades federativas, a fin de obtener información y documentación actualizada de las niñas, niños y adolescentes en situación de orfandad.
El Registro estará regido por las disposiciones en materia de protección de datos personales, protegiendo los derechos e interés superior de niñas, niños y adolescentes en situación de orfandad.
El Sistema Nacional de Protección Integral emprenderá acciones enfocadas a promover, garantizar, proteger y restituir sus derechos, elaborar un diagnóstico sobre la problemática de orfandad en donde se esbocen sus diversas causas como serían: muerte de la madre con posterioridad al alumbramiento, accidentes, feminicidio u homicidio, enfermedad, desaparición de alguno o ambos padres o de quien ejerza la patria potestad, tutela o guarda, o custodia, entre otras causas.
Considera necesario diseñar e implementar estrategias, planes, programas, instrumentos y mecanismos de apoyos de carácter social, psicológico, salud, educativo para su atención inmediata, salvaguardando el interés superior de la niñez y restitución integral de sus derechos.
Expone que la Unicef ha señalado que la pandemia ha impactado a los hogares de las niñas, niños y adolescentes, registrándose un incremento en los casos de hambruna, mala nutrición, incremento en la pobreza, en el núcleo familiar, abusos y violencia, así como situaciones de ansiedad y depresión, afectando su salud mental.
Según cifras publicadas en diversos estudios, en México existen cerca de 131 mil 325 niñas, niños y adolescentes en situación de orfandad por causa del Covid-19.Por ello, añade, es vital reformar la Ley General de los Derechos de las Niñas, Niños y Adolescentes, en materia de protección en situación de orfandad.
Además, datos del Sistema Nacional para el Desarrollo Integral de la Familia (DIF) señalan que en la Ciudad de México la pandemia ha dejado a más de 2 mil 550 niñas, niños y adolescentes en orfandad.
“No hay que olvidar que es obligación del Estado mexicano velar por el interés de la niñez y es momento de establecer lineamientos para evitar que los menores de edad, en situación de orfandad, queden en el abandono y que su futuro se convierta en incierto”, afirma.
