El Congreso de Aguascalientes aprobó este miércoles reformas al Código Penal del estado para reducir el plazo de la interrupción legal del embarazo de 12 a 6 semanas de gestación, con 19 votos a favor, seis en contra y una abstención.
La decisión, impulsada por la mayoría panista en el Congreso, contraviene la resolución de la Suprema Corte de Justicia de la Nación (SCJN) que, en 2021, despenalizó el aborto voluntario en las primeras 12 semanas de gestación en todo el país.
El mandato de la SCJN establecía que, antes del 30 de agosto, el Congreso de Aguascalientes debía aprobar reformas que garantizaran la despenalización del aborto dentro del periodo de 12 semanas.
Sin embargo, en una sesión extraordinaria, la LXV Legislatura local, en su último periodo de trabajo, aprobó cambios a los artículos 101, 102, 103 y 196 del Código Penal que reducen este plazo a 6 semanas.
La propuesta para esta modificación fue respaldada por 20 de los 27 legisladores de diversos partidos, incluyendo el Partido Acción Nacional (PAN), Partido Revolucionario Institucional (PRI), Partido de la Revolución Democrática (PRD), Morena y Partido Verde Ecologista de México (PVEM).
Adicionalmente, con 23 votos a favor, el Congreso estatal aprobó la Ley de Protección a la Vida, promovida por la gobernadora de Aguascalientes, Tere Jiménez Esquivel.
La ley complementa las reformas al Código Penal y refuerza la protección legal del feto desde las primeras etapas de la gestación.
La SCJN, en 2021 y 2022, ya había declarado inconstitucionales las normativas que protegían la vida desde la concepción, considerando que estas limitaban el derecho a la autonomía reproductiva y a la salud de las mujeres y personas gestantes, como hombres trans y personas no binarias.
A pesar de estos precedentes legales, las reformas aprobadas en Aguascalientes representan un retroceso en los derechos reproductivos de las mujeres y personas gestantes en el estado.
