El activista José Humbertus Pérez Espinosa fue detenido en noviembre de 2015 tras una conferencia de prensa ofrecida en la ciudad de Toluca y trasladado al penal de Chiconautla, desde donde ha denunciado una serie de irregulares en su caso, como la fabricación del delito, incluso durante la visita del Papa Francisco al Estado de México, inició una huelga de hambre junto con otros reos del penal.
A decir del activista durante las últimas dos audiencias se han violado sus derechos humanos y este último fallo se trata de una venganza en su contra.
¿QUIÉN ES HUMBERTUS PÉREZ ESPINOSA?
José Humbertus Pérez Espinosa, es de profesión abogado, dirigente y representante legal de la asociación civil Frente Mexiquense en Defensa para una Vivienda Digna.
Humbertus Pérez se ha dedicado a denunciar a constructoras, por la mala calidad de los materiales que usan para la construcción de viviendas en la entidad mexiquense.
Ha logrado ganar varios litigios en contra de dichas empresas, en los cuales ha acusado actos de corrupción por parte de funcionarios públicos tanto municipales como estatales.
Previo a su detención José Humbertus Pérez Espinosa y el frente al que representa habían entablado un denuncia en contra de Urbi Desarrollos Urbanos, Sadasi, Homex, Geo, Ara, Sare y Promotora Integrales de Viviendas entre otras empresas constructoras y acusó a líderes de los comités seccionales del PRI del despojo de casas con uso de armas y violencia, protegidos por Vicente, hermano de Aarón Urbina Bedolla, entonces alcalde electo de Tecámac, y por el secretario de Seguridad Pública de esa demarcación, Carlos Medina Olivares.
LO ACUSAN DE ROBO CON VIOLENCIA
José Humbertus Pérez Espinosa, quien también era profesor del Instituto Politécnico Nacional fue acusado de robo con violencia a dos casas-habitación.
De acuerdo con las investigaciones Pérez Espinosa sustrajo un teléfono y una tableta electrónica, cuyo valor establecido por los peritajes oficiales no rebasan en conjunto los mil 300 pesos.
El presunto robo le fue imputado por Delia Hernández y Noé Cerón, quienes a decir del activista, fueron enviados por Aarón Urbina, alcalde de Tecámac –contra quien existe una orden de aprehensión no cumplimentada por liberar conjuntos urbanos que no reunían los requisitos de ley.
PROTESTAS CONTRA SU DETENCIÓN
Tras la detención de Humbertus Pérez, integrantes del Frente Mexiquense en Defensa para una Vivienda Digna, exigieron la libertad de su líder, acusando a las autoridades estatales de fabricar delitos en su contra para evitar que continúe luchando en contra de las constructoras.
Como parte de las acciones el Frente lanzó una petición en la página de change.org,donde escribieron “La lucha del Lic Humbertus Perez dirigente del www.frentemex.org.mx ha sido por la vía jurídica y pacífica es un luchador social que defiende el derecho humano a una vivienda digna y decorosa en México, de forma inédita ha logrado grandes triunfo jurídicos y ayudado a cientos de familias de que sean despojadas de su único patrimonio por la mafia Hipotecaria en México, el gobierno del Estado de México encabezado por el gobernador Eruviel Avila y su procurador de justicia así como el presidente electo en Tecamac Aroon Urbina han violentado el estado de derecho fabricándole delitos graves para acallarlo, detenerlo y encancelarlo, por favor ayudanos a firmar esta petición para que sea puesto en libertad inmediata, por tu ayuda. Gracias !!”
Posteriormente el 25 de febrero en Toluca exigieron al presidente del Tribunal Superior de Justicia, Sergio Javier Medina Peñaloza, que el juez que lleva el caso se ajuste al marco del derecho y reconozca que la detención no se realizó conforme a la ley.
EN DOS OCASIONES SE ORDENÓ SU LIBERTAD
Durante una audiencia celebrada el 15 de enero de 2016 en la juez de la Sala de Apelaciones del penal de Chiconautla se ordenó su inmediata libertad por falta de pruebas e imputaciones contradictorias en el expediente 1720/15, pero el activista debió permanecer en el penal en espera de la audiencia del 21 de por el juicio 1718/15, en el que se le acusa por el mismo delito.
En la audiencia del 25 de enero, el juez de control del penal de Ecatepec, Israel Chávez Picazo, dictó auto de libertad a favor de José Humbertus Pérez Espinoza.
A pesar de estos dos fallos a su favor, el activista continúa preso en Chiconautla, donde el pasado viernes se le dictó auto de formal prisión.
