La Subdirección de Tenencia de la Tierra, adscrita a la Dirección de Ordenamiento Territorial y Desarrollo Urbano de Atizapán de Zaragoza, ha asesorado de manera gratuita y personalizada -en lo que va del año- a 886 personas que buscan regularizar el predio en el que habitan.
De acuerdo con Lucio Santiago Martínez, Subdirector de Tenencia de la Tierra, de enero a principios de octubre se han instalado 16 módulos itinerantes en diferentes colonias del territorio municipal, lo que acerca el trámite a la ciudadanía y evita gastos y tiempos invertidos en traslados.
“Lo que hacemos en los módulos itinerantes es brindar asesoría personalizada para que los ciudadanos atizapenses que se encuentran ubicados dentro de un asentamiento humano irregular puedan obtener certeza jurídica de su patrimonio a través de las dependencias creadas para este fin, como lo son el Instituto Nacional del Suelo Sustentable (INSUS), que regulariza propiedad social, y el Instituto Mexiquense de la Vivienda Social (IMEVIS), que regulariza predios en propiedad privada”, describió Santiago Martínez.
Gracias a lo anterior, estarían regularizando 156 lotes en colaboración con el INSUS y con el IMEVIS en el 2023, esto es 36 más que el año pasado, cuando se escrituraron 120 predios.
El éxito de la regularización de cada predio depende de las opiniones, acuerdos, autorizaciones, informes y dictámenes hechos por las leyes, estudios, reglamentos o normatividad vigente de las dependencias involucradas.
Para tramitar, los interesados requieren identificación oficial vigente, cesión de derechos o contrato de compraventa, recibos de pago de servicios como luz, agua, teléfono, y un croquis de localización del inmueble, aunque las autoridades pueden requerir mapas u otros documentos, lo que dependerá de las normas de operación y del proceso de regularización que se realice de acuerdo con las condiciones del asentamiento en el que se encuentren.
“La asesoría en el módulo de regularización de Tenencia de la Tierra varía de 5 a 10 minutos, aproximadamente, pero el tiempo que tarda el proceso de regularización es indefinido ya que depende de las diferentes instancias involucradas en el trámite”, añadió.
Y sobre el tiempo que tarda en lograrse la regularización es indefinido porque no depende de la instancia municipal solamente, sino de la afectación o situación de restricción de cada predio, por lo que intervienen dependencias de los 3 niveles de gobierno, entre ellas las federales: Secretaría de Desarrollo Agrario, Territorial y Urbano (Sedatu), Registro Agrario Nacional (RAN), Comisión Nacional del Agua (Conagua) y el ya mencionado INSUS.
Por parte del Gobierno del Estado de México se involucran el IMEVIS, el Instituto de la Función Registral del Estado de México (IFREM), Protección Civil, Comisión del Agua del Estado de México (CAEM), Operación y Control Urbano.
De nivel municipal participan la Dirección General de Ordenamiento Territorial y Desarrollo Urbano, la Subdirección de Tenencia de la Tierra, la Tesorería, Protección Civil y Patrimonio municipal.
En Atizapán de Zaragoza, hay asentamientos irregulares de hasta 40 años de antigüedad, de los cuales hay algunos que no se podrán regularizar debido a que se instalaron en zonas de torres de alta tensión, barrancas o derechos de vía, por ejemplo.
“Cuando se da el asentamiento humano es por necesidad, la gente compra donde le venden y siempre hay una persona oportunista que vende con tal de sacar un interés económico”, describió el funcionario.
La meta que se tiene de asesorías para el 2024 es de 1,200 ciudadanos en más del 50% de las colonias populares que comprenden el territorio municipal y los módulos se colocan como parte de las jornadas Unidos Trabajando por tu Colonia.
“Regularizar un predio representa tranquilidad y paz al tener el tan anhelado documento que los acredita como legítimos propietarios. Hay gente que se emociona, que llora y que no puede creer que tenga en sus manos el título de propiedad. Este título de propiedad es como el certificado de nacimiento de una casa, es la cédula de identidad de una vivienda”, finalizó Santiago Martínez.
