Aseguran que la Unión Nacional de Ejidos Forestales y Agropecuarios (Unefa) es quien ha promovido la ocupación y venta de lotes.
Honorio Gómez, uno de los abogados de la Comunidad, señaló que habían tenido un acuerdo con la Unefa a fin de sumar fuerzas y evitar que los terrenos fueran ocupados por la desarrolladora Frisa. El convenio se firmó el 17 de enero.
Gómez también mostró un documento con fecha 25 de febrero de 2016 en el que da por finiquitada la relación con la organización ejidal, en la que prohíbe que ésta intervenga, realice tratos comerciales u otorgue porciones del predio en cuestión.
Reconocieron que la autoridad es la competente de fraccionar o lotificar y no los comuneros, y estimaron que al menos mil 500 personas dieron dinero a la Unefa para poseer una porción del cerro.

“Se ha manejado una mala información de que la comunidad es fraccionador o lotificador, eso es una gran mentira”, dijo Jassain Cureño, otro de los representantes legales de los comuneros.
Indicaron que la disputa legal con FRISA sigue en curso, aunque, añadieron, ya sostienen pláticas con la constructora para convenir un pago tanto en especie como en efectivo.
Mostraron documentos emitidos por el Tribunal Unitario Agrario con fecha de 25 de abril de 2014, en los que se reconoce a dicha comunidad como la propietaria de mil 457 hectáreas, en el que se encuentra dicho cerro.
