Un Juez del Distrito Judicial de Lerma dictó una sentencia condenatoria de 12 años y seis meses de prisión para Gerardo Alberto Rivera Alarcón, alias “El Brea”, después de que el Agente del Ministerio Público de la Fiscalía Central de Delitos Vinculados a la Violencia de Género de la Fiscalía General de Justicia Estatal (FGJEM) acreditó su probable participación en el delito de violación equiparada en agravio de una joven de 25 años.
La indagatoria iniciada por estos hechos permitió establecer que el día 7 de octubre del año 2020, la víctima se encontraba en un inmueble ubicado en la localidad de San Pedro Cholula, en el municipio de Ocoyoacac, donde ingirió bebidas alcohólicas con una de sus amigas y el ahora sentenciado.
En algún momento la joven comenzó a sentirse mal por lo que ingresó a una de las habitaciones y se acostó en una cama, situación que aprovechó Gerardo Alberto para someterla y agredirla sexualmente.
Derivado de estos hechos fue iniciada la carpeta de investigación respectiva por el delito de violación equiparada, en la hipótesis de cuando por cualquier otra causa la víctima no pudiera resistirse al hecho, y derivado de las indagatorias realizadas fue posible identificar y aprehender al probable partícipe.
Este sujeto fue ingresado al Centro Penitenciario y de Reinserción Social de Lerma, donde un Juez luego de revisar los elementos de prueba recabados y aportados por esta Representación Social, le dictó esta sentencia condenatoria, además le fijó multas de 56 mil 472 pesos y 124 mil 800 pesos como reparación del daño material, aunado a que sus derechos civiles y políticos quedaron suspendidos.
