El Juzgado Décimo Tercero de Distrito de Amparo en Materia Penal concedió una suspensión provisional al jefe delegacional de Tláhuac, Rigoberto Salgado Vázquez, que impide a la Procuraduría General de Justicia de la Ciudad de México consignar cualquier carpeta de investigación en su contra hasta que él pueda acceder a la misma en caso de existir.
El juez Jesús Alberto Chávez Hernández aclaró que la medida cautelar no imposibilita al fiscal continuar con su investigación e integración de la carpeta.
“Sin que lo expuesto implique la paralización del procedimiento de origen, ni que el agente del Ministerio Público investigador vea limitadas sus facultades para la integración de la indagatoria correspondiente, en términos del artículo 21 de la Constitución General de la República, pues como se precisó en párrafos que anteceden, la medida cautelar únicamente tiene por objeto que una vez agotadas las diligencias en la carpeta de investigación, no se determine, pero se insiste, ello no impide que el fiscal cumpla con su función de investigación y persecución de delitos”.
De acuerdo con el expediente 938/2017, Salgado Vázquez impugnó los actos del responsable de la agencia “A” de la Unidad A-4 sin Detenido para la Fiscalía de los Delitos cometidos por Servidores Públicos de la procuraduría capitalina.
El juez Chávez Hernández pidió a las autoridades señaladas como responsables presentar por duplicado su informe previo en un plazo de 48 horas, contado a partir de que queden notificadas.
