El Instituto Nacional de Transparencia instruyó a la Secretaría de la Función Pública (SFP) entregar versión pública de la base de datos del Sistema de Procedimientos Administrativos de Responsabilidades.
En dicha base de datos los Órganos Internos de Control en la Administración Pública Federal capturan el estado procesal de cada uno de los asuntos a su cargo.
En respuesta y respecto de la base de datos denominada “Sistema de Procedimientos Administrativos de Responsabilidad”, la SFP señaló que no cuenta con una versión pública de la misma, en virtud de que se trata de un sistema de control y seguimiento interno; por lo que la información tal y como la requiere la particular es inexistente.
El particular apeló la respuesta mediante recurso de revisión ante el Instituto Nacional de Transparencia, Acceso a la Información y Protección de Datos Personales (Inai) que fue turnado a la ponencia del comisionado Francisco Javier Acuña Llamas.
Durante la substanciación del asunto, se advirtió que en el Sistema de Procedimientos Administrativos de Responsabilidades, los Órganos Internos de Control en las dependencias y entidades de la Administración Pública Federal capturan la información de los procesos de responsabilidad administrativa contra servidores públicos.
Así como la información relativa al servidor o servidores públicos que forman parte del mismo.
Asimismo, en la revisión del asunto, se solicitaron dos opiniones a la Dirección General de Tecnologías de la Información del Inai para que examinara los recursos del Sistema de Procedimientos Administrativos.
En sus dictámenes, la referida dirección señaló que es técnicamente viable extraer la información y generar una versión pública de la base de datos MySQL del Sistema, mediante la herramienta tecnológica conocida como “MySQLWorkbench”, que es de acceso fácil y gratuito.
El comisionado Acuña Llamas expuso ante el pleno que después de cuatro diligencias especiales, dos requerimientos adicionales de información y dos opiniones técnicas, “el sujeto obligado no puede eludir que existe factibilidad tecnológica para dar versión pública de ese sistema de control interno, que aunque sea de control interno, es un bien público”.
Con base en las consideraciones técnicas vertidas, se concluyó que la Secretaría de la Función Pública se encuentra en posibilidad de generar versión pública del Sistema de Procedimientos Administrativos de Responsabilidades.
Por ello, el pleno del Inai resolvió modificar la respuesta del sujeto obligado y le ordenó entregar al particular versión pública del sistema, protegiendo los datos personales relativos al Registro Federal de Contribuyentes, la Clave Única de Registro Poblacional, sexo, domicilio particular y números telefónicos de particulares o de celular.
